Terms of sale
1. Purpose
These General Terms and Conditions of Sale (hereinafter the "GTC") define the rights and obligations of the parties in connection with the online sale of wines, spirits and related products offered by SARL QUVEE, with a share capital of €1,000, registered with the Bordeaux Trade and Companies Register (RCS) under number 84042646400011, whose registered office is located at 355 Avenue Thiers, 33100 Bordeaux, France (hereinafter the "Seller"), on the website https://quvee.fr (hereinafter the "Website").
2. Scope
These GTC apply to all orders placed on the Website by adult consumers, in accordance with the French legislation in force regarding the sale of alcohol.
Any order implies the customer's full and unreserved acceptance of these terms and conditions.
3. Products
The products offered for sale are those appearing on the Website on the date of the order.
Each product is presented with a description and a photograph for illustrative purposes only.
Vintages, formats or labels may differ slightly depending on the availability from producers or suppliers, without any alteration to the quality of the product.
3.1 Living Products
Wines and spirits are living products that naturally evolve over time.
Their taste, color, aromas and balance may vary depending on storage conditions, temperature, transport or vintage.
These changes are part of the very nature of the product.
Consequently, no claim or refund request will be accepted for a wine showing an organoleptic defect (cork taint, oxidation, atypical evolution, off-flavor, etc.), unless a proven defect attributable to the Seller is established (shipping error, non-conforming vintage, bottle obviously defective before shipment).
4. Prices
Prices are indicated in euros, inclusive of all taxes (VAT included), excluding delivery costs.
Shipping costs are specified before the final validation of the order.
SARL QUVEE reserves the right to change its prices at any time, but products will be invoiced at the prices in effect at the time of the order.
5. Orders
The customer validates their order after checking the contents of their cart and accepting these GTC.
The order becomes final upon receipt of full payment.
A confirmation e-mail summarizing the ordered products is sent to the customer.
6. Availability and Stock Errors
Products are offered while stocks last.
Despite regular updates to our database, an ordered product may in fact be unavailable (stock error, shortage, sold-out vintage, etc.).
In this case:
- The customer will be informed as soon as possible by e-mail or telephone;
- The order for the product concerned will be cancelled and fully refunded using the same payment method used when placing the order;
- The other available products will be shipped as normal, unless the customer requests otherwise.
No additional compensation may be claimed on the grounds of unavailability.
7. Payment
Payment is made online via a secure system (Bank Card, Visa, Mastercard).
The order will only be shipped after full payment has been validated.
8. Delivery
Deliveries are carried out through the Boxtal service, which ships parcels via Chronopost, Mondial Relay or FedEx.
Orders are shipped to the address provided by the customer when placing the order.
The delivery times indicated when placing the order are provided for guidance only and may vary depending on the carrier chosen.
You can view our shipping policy by clicking here.
8.1 Loss or Breakage of Parcels
In the event of loss, theft or breakage of one or more parcels during transport, compensation will be paid to the customer up to the limit provided by the carrier concerned (Chronopost or UPS).
The amount and conditions of compensation depend on the carrier's compensation rules at the time of the incident.
The customer may, if they wish, take out additional insurance when placing their order in order to benefit from higher coverage, which is recommended for high-value items (grands crus, rare spirits, limited editions, etc.).
8.2 Receipt of Parcels
The customer is required to check the condition of the parcels upon receipt.
In the event of an issue (damaged parcel, broken bottle, opened packaging, etc.), they must:
- state specific reservations on the delivery slip,
- and inform QUVEE within 48 hours at bastide@quvee.fr, attaching supporting photos, so that a claim can be opened with the carrier.
8.3 Delivery Delays
In the event of an abnormal delay or non-delivery after a reasonable period, the customer is invited to contact customer service at bastide@quvee.fr.
If the order cannot be delivered, it will be fully refunded.
9. Right of Withdrawal
In accordance with Article L.221-18 of the French Consumer Code, the customer has a period of 14 days from receipt of their order to exercise their right of withdrawal.
Products must be unopened, unconsumed and in perfect condition.
Return costs are borne by the customer, unless there was a preparation error attributable to QUVEE.
10. Retention of Title
The products remain the property of QUVEE until the customer has paid the price in full.
11. Protection of Minors
In accordance with Article L.3342-1 of the French Public Health Code, the sale of alcohol is strictly prohibited to minors under 18 years of age.
By validating their order, the customer declares that they are at least 18 years old.
12. Liability
The Seller cannot be held liable for any damage resulting from misuse of the purchased products.
Its liability cannot be engaged in the event of force majeure, carrier failure, or fault of the customer.
13. Personal Data
The personal data collected is necessary for order management and customer relations.
It is processed in accordance with the General Data Protection Regulation (GDPR).
The customer has the right to access, rectify and delete their data by sending a request to bastide@quvee.fr.
14. Applicable Law and Disputes
These GTC are governed by French law.
In the event of a dispute, and failing an amicable agreement, the competent courts will be those within the jurisdiction of the registered office of SARL QUVEE.
